HARTFORD, Conn. (AP) — The state's second-highest court has ordered a new trial for a Waterbury man convicted of sexually assaulting his ex-girlfriend's daughter over an eight-year period, saying most of the crimes occurred after the statute of limitations expired.
The Appellate Court on Tuesday overturned the convictions of 45-year-old Richard Brundage, who was sentenced to 20 years in prison in 2010. He remains jailed on $50,000 bail in a pending child sexual assault case.
Brundage was convicted of sexually assaulting the girl numerous times from 1994, when she was about 8 years old, to October 2002.
The Appellate Court ruled the trial judge wrongly applied a new statute of limitations that took effect in 2002 retroactively. The court says Brundage can't be prosecuted for sexual assaults that occurred before May 23, 2002.
