New Haven, Conn. (WTNH) - In New Haven Superior Court prosecutors revealed more details on how they plan to argue their case against one of the men charged in the deadly Cheshire home invasion.
The trial of Steven Hayes is just days away.
Wednesday, Judge Jon Blue basically told lawyers for Hayes they will have to craft a defense based on the information they already have, meaning prosecutors do not have to turn over any of the grizzly details until the case is in trial.
Lawyers for Steven Hayes were seeking more details about the state’s case in the killings, details the state may use to show that the crimes meet the criteria for imposing the death penalty.
Prosecutors did say they will tell jurors the three Petits were killed in an especially heinous, cruel and depraved manner. They will also argue Hayes posed a grave risk to police and firefighters by setting the Petit family home on fire.
Judge Blue rejected most of the defense's request and sided with the state saying Hayes's lawyers have enough information to mount a defense and will have to wait until the trial to hear the state's theory of what happened on that day in July of 2007.
The sole survivor of the Cheshire home invasion, Dr. William Petit, did not want to speak to reporters after the hearing focused on the exact manner and motive for the murders of his wife Jennifer Hawke Petit and their daughters 17-year-old Hayley and 11-year-old Michaela.
Hayes and Joshua Komisarjevskly are both charged with the killings and both face the possibility of the death penalty if convicted.
The trial for Steven Hayes is set to start on Sept. 13.
