Occupy New Haven to be evicted

NEW HAVEN, Conn. (WTNH/AP) — The US appeals court ruled Tuesday that the city of New Haven can resume evicting Occupy New Haven protesters from the Green.

The 2nd U.S. Circuit Court of Appeals in New York ruled in the city's favor Tuesday, allowing the city to evict protesters, who have been at the site for six months.

"Once again, the court's action today was decisive. The plaintiffs have no meaningful chance of success. The City of New Haven has respected the rule of law and we expect that members of Occupy New Haven will do the same," the City of New Haven said in a statement.

A lawyer for the protesters says there is "nothing more the federal court can or will do."

Occupy demonstrators know the inevitable is near as the city can now evict them at any time, so they've started taking down tarps and tents to prepare for the eviction.

"The tents to me it's a sacred place," said Ray Neal, Occupy demonstrator, "it was the beginning. I'm going to be crying when they go down."

After holding what they called an emergency general assembly meeting, the group decided to take apart the encampment themselves. They said they wanted to leave their home in good condition.

Many said Tuesday that it was a sad day to see the encampment being taken down.

While they may be leaving the Green a little more brown, they said their time there made a difference in some important ways.

"I think we did because we opened peoples' eyes and made people look at us," one protestor said. "Unfortunately, they don't want to look anymore."

The structures may be gone, but some demonstrators say they plan to remain on the Green until the city comes in and makes them leave.

"I think the ruling was wrong," said Neal, "so I should stand up for what I believe in."

The city is not commenting on when it will be evicting the demonstrators, but that can happen at any time.
