Yale U-Haul driver passes sobriety test

New Haven, Conn. (WTNH) - When a U-Haul truck plowed through the Lot D parking lot at the Yale-Harvard game on Saturday, striking three and killing one , many assumed the driver was drunk; but police said that is not the case.

New Haven Police said the driver, Brendan Ross, of 31 High Street, New Haven, passed a field sobriety test.

His attorney released a statement that said the accident was the result of a vehicle malfunction.

The scene, which was described as a "nightmare" by tailgaters is still fresh in their minds a day later.

Max Rantz McDonald said he's waited years to go to a Yale-Harvard game. He traveled all the way from Ireland, however, it was difficult to enjoy given the tragic start.

"It's just a shame it was overshadowed by such tragedy," said Mcdonald.

News 8 is told that Ross lives at Sig Ep, but as soon as we walked down the street all area fraternity brothers ran inside.

Mcdonald said the reaction is surprising given the fact that Ross passed the field sobriety test.

"That's great," said Mcdonald. "I mean mo one wants drunk driving hopefully. It was just, there's nothing that can rewrite what happened or make it right, you just think of the victim's family."

Students say they're sickened by what happened, but are happy to hear that alcohol wasn't the cause.

"Cause then you know it's not really an accident anymore, it's a choice that he made to drive," one student said, "but he didn't. That's the good part of the story."

As of yet, no charges have been filed against Ross. Police said it is still early in the investigation.
