News 8 has obtained a copy of the lawsuit which can be read below:
Bianca has brought this action for the City’s (1) failure to afford her a Loudermill hearing; (2) failing to afford her a post-termination hearing; and (3) failure to pay her vacation time which she had accrued over the course of her seventeen years of employment with the City. She is seeking compensatory damages, attorney fees, costs, and punitive damages.
Loudermill is a reference to the decision of the United State Supreme Court in the matter of Cleveland Bd. of Educ. v. Loudermill, 470 U.S. 532, 105 S.Ct. 1487, 84 L.Ed.2d 494 (1985), which held that governmental employees, like Bianca, have the right to a pretermination hearing, at which the employee is informed of the grounds for termination and the evidence on which the decision was based and at which the employee is given an opportunity to be heard. Bianca was summarily fired without being afforded this right.
News 8 reached out to the City of New Haven for comment. They said that were not able to comment, as they have yet not been served with this lawsuit.
