Officers from New Haven police shooting failed to activate body cameras

A new, clearer piece of video obtained by News 8 appears to show Paul Witherspoon being shot at by police while his hands were in the air.

In the video provided by Believe In Me Empowerment Corporation, you can see the driver door open, then seconds later both of Witherspoon’s hands go up.

Next, you see Hamden Ofc. Devin Eaton pull up with no lights, no siren and no indication of a traffic stop. Eaton can be seen jumping out and begin shooting almost instantly.

At the same time Witherspoon appears to duck back in the vehicle for cover. News 8 editors were able to enhance the video by slowing it down and brightening the picture. In the enhanced version, you can better see the chain of events leading up to the controversial shooting.  

Witherspoon wasn’t physically injured, but his girlfriend, Stephanie Washington, was shot in the torso, according to state police investigators who have taken over the case.

Just a few hours after the shooting, Witherspoon talked only to News 8’s Mario Boone about why he tried to get out of the car. He said Eaton ordered him out of the car saying, “After they got out the car they were more like ‘put your f*****g hands up and get the f**k out the car!’ literally.”

Commissioner James C. Rovella of the Department of Emergency Services and Public Protection held a news conference Tuesday at state police headquarters regarding body cam footage.

For the first time, we learned Yale Officer Terrance Pollock had both a body cam and dash cam, but never turned on either.

Ofc. Eaton’s cruiser was not equipped with a dash.

His body cam recorded only part of the shooting because he, too, failed to turn it on during the shooting.

The chain of events were set off by a 911 call reporting an alleged armed robbery.

The store clerk gave a detailed description of a car driven by Witherspoon and Washington.

At 4:26 a.m. a BOLO was issued to New Haven police, but Hamden doesn’t say its officer is crossing into New Haven’s jurisdiction.
